The Marketing GP 13th Birthday Competition

1. Promoter
This competition is promoted by The Marketing GP Pty Ltd ( “we”, “us”, “our”), located at 89 Young St, Carrington NSW.
2. Competition Period
The competition commences at 12:00am AEDT on 29 October 2025 and closes at 11:59pm AEDT on 27 November 2025 (“Competition Period”). All entries must be received during the Competition Period to be eligible.
3. Eligibility
3.1 Entry is open to Australian residents aged 18 years or over who are:
- Directors, owners, or authorised decision-makers of a registered Australian business
- Operating a business with a current ABN
3.2 The following persons are ineligible to enter:
- Employees of The Marketing GP and their immediate families
- Current clients of The Marketing GP with active service contracts
- Individuals or businesses who have worked with The Marketing GP in the 12 months prior to competition commencement
3.3 By entering, you warrant that you have authority to enter on behalf of the business nominated and to bind that business to these terms and conditions.
4. How to Enter
4.1 To enter, entrants must:
- Visit https://themarketinggp.com.au/13th-birthday/ during the Competition Period
- Complete the online entry form in full, including:
- Business name
- Contact name, email address, and phone number
- Responses to form questions
- Selection of preferred prize category (Logo, Website, or Strategy)
- Submit the completed form
4.2 Entry is free. No purchase is necessary.
4.3 Only one entry per business/ABN is permitted.
4.4 Entries must be submitted by an authorised representative of the business.
4.5 Incomplete, illegible, or fraudulent entries will be deemed invalid.
4.6 The Marketing GP accepts no responsibility for late, lost, misdirected, or incomplete entries.
5. Prize Details
5.1 There is one (1) major prize to be won, consisting of the winner’s choice of ONE of the following packages:
Option 1: Premium Logo Package (valued at $6,000)
- Brand discovery and strategy session
- Logo design concepts and revisions
- Final logo files in all required formats
- Brand style guide
- Business card design
- Email signature design
Option 2: Essentials Website Package (valued at $6,000)
- Website discovery session
- Up to 5-page website design
- Mobile-responsive development
- Basic SEO optimisation
- 30 days post-launch support
Option 3: Marketing Strategy Package (valued at $6,000)
- Comprehensive business and marketing audit
- Competitor and market analysis
- Target audience research and persona development
- 12-month marketing strategy and implementation roadmap
- Marketing messaging and positioning framework
- 90-day action plan with priorities
5.2 The prize must be redeemed within 6 months of winner notification.
5.3 The prize is non-transferable and cannot be exchanged for cash or other goods/services.
5.4 The prize cannot be combined with any other offers, discounts, or promotions.
5.5 The prize winner cannot switch between prize options once their selection is confirmed.
5.6 Any costs associated with the prize not specifically included in the prize description are the responsibility of the winner, including but not limited to:
- Domain registration and hosting fees (for website prize)
- Stock photography or videography
- Copywriting services beyond standard inclusions
- Additional pages or features beyond package scope
- Ongoing website maintenance or marketing implementation
5.7 The Marketing GP reserves the right to substitute the prize with another prize of equal or greater value if circumstances beyond its control make it necessary.
5.8 Prize values are based on The Marketing GP’s standard pricing and are quoted in Australian dollars (AUD) excluding GST.
6. Winner Selection
6.1 The winner will be selected by founder’s choice from all eligible entries received during the Competition Period.
6.2 The draw will be conducted at The Marketing GP’s offices at 89 Young Street Carrington on 28 November 2025.
6.3 The first valid entry drawn will be the winner. Additional entries may be drawn as reserves in case the winner is deemed ineligible or cannot be contacted.
6.4 The winner will be notified by email and phone within two (2) business days of the draw.
6.5 The winner’s name and business name will be published on The Marketing GP’s website and social media channels within fourteen (14) days of the draw, pending approval from the winner.
6.6 If the winner cannot be contacted within five (5) business days of the initial notification attempt, or if the winner does not claim their prize within fourteen (14) days of notification, the prize will be forfeited and a new winner will be drawn.
7. Prize Redemption and Delivery
7.1 The winner must confirm their prize selection within seven (7) days of notification.
7.2 The winner must be available to participate in the prize fulfilment process, including:
- Attending briefing sessions and meetings (in-person or virtual)
- Providing required information, content, and materials in a timely manner
- Responding to communications within agreed timeframes
- Providing feedback during development phases
7.3 Project commencement is subject to The Marketing GP’s current workload and scheduling capacity, typically within 4-8 weeks of prize confirmation.
7.4 The winner agrees to work collaboratively with The Marketing GP throughout the project and acknowledges that delays caused by the winner’s unavailability or failure to provide required materials may extend the project timeline.
7.5The Marketing GP’s standard service terms and conditions will apply to the delivery of prize services.
7.6 The prize must be fully redeemed within 12 months of winner notification, after which time the prize will expire with no compensation.
8. Marketing and Publicity
8.1 By entering, entrants consent to The Marketing GP using their business name and entry information for prize administration purposes.
8.2 The winner consents to The Marketing GP using their name, business name, business location, photograph, and testimonial for marketing and promotional purposes across all media channels without additional compensation, unless otherwise agreed in writing.
8.3 The Marketing GP may create case study content documenting the winner’s project journey, including before/after comparisons, for marketing purposes.
8.4 The winner grants The Marketing GP permission to display the completed work in their portfolio and use it for promotional purposes.
8.5 If the winner wishes to remain anonymous or restrict certain promotional uses, this must be communicated in writing to The Marketing GP within seven (7) days of winner notification.
10. Privacy and Data Collection
10.1 By entering, entrants consent to The Marketing GP collecting, storing, and using their personal information for the purposes of:
- Administering the competition
- Announcing and notifying the winner
- Delivering the prize
- Marketing and promotional activities (unless the entrant opts out)
10.2 Personal information will be handled in accordance with The Marketing GP’s Privacy Policy available at themarketingp.com.au/privacy-policy
10.3 Entrants may opt out of marketing communications at any time by clicking the unsubscribe link in emails or contacting The Marketing GP directly.
10.4 Personal information will not be disclosed to third parties except as required for prize delivery or as permitted by law.
11. Intellectual Property
11.1 All competition materials, including but not limited to the competition concept, design, and promotional materials, are the intellectual property of The Marketing GP.
11.2 Upon full payment of any applicable fees (if outside prize scope) and completion of the project, intellectual property rights in the final deliverables will transfer to the winner, except for The Marketing GP’s right to use the work for portfolio and promotional purposes.
11.3 The Marketing GP retains intellectual property rights in any preliminary concepts, working files, methodologies, and processes used in creating the deliverables.
12. Liability and Indemnity
12.1 To the fullest extent permitted by law, The Marketing GP excludes all liability for any loss, damage, or injury suffered by any entrant in connection with the competition or prize, except for liability that cannot be excluded by law.
12.2 The Marketing GP is not responsible for:
- Any technical difficulties, malfunctions, or failures affecting entry or participation
- Any unauthorised access to or interference with the competition
- Any entry or communication that is late, lost, misdirected, incomplete, or illegible
- Any variation in prize value
12.3 The Marketing GP is not liable for any tax implications arising from the prize. Winners should seek independent financial advice.
12.4 If the prize is unavailable due to circumstances beyondThe Marketing GP’s control, The Marketing GP reserves the right to substitute a prize of equal or greater value.
12.5 Entrants indemnify The Marketing GP against any liability, claim, or expense arising from their breach of these terms and conditions.
13. General Conditions
13.1 The Marketing GP reserves the right to verify the validity of entries and to disqualify any entrant who:
- Tampers with the entry process
- Submits an entry that is not in accordance with these terms and conditions
- Acts in a fraudulent or inappropriate manner
13.2 The Marketing GP reserves the right to cancel, terminate, modify, or suspend the competition if it becomes impracticable to conduct it as planned, including due to circumstances beyond its reasonable control.
13.3 Any costs incurred by entrants in entering the competition are not recoverable.
13.4 The Marketing GP’s decision regarding all aspects of the competition is final, and no correspondence will be entered into.
13.5 These terms and conditions are governed by the laws of New South Wales, Australia. Entrants submit to the non-exclusive jurisdiction of the courts of New South Wales.
13.6 If any provision of these terms and conditions is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force.
14. Permits and Compliance
14.1 This competition is conducted in accordance with relevant Australian legislation, including:
- Competition and Consumer Act 2010 (Cth)
- Australian Consumer Law
- Privacy Act 1988 (Cth)
- Spam Act 2003 (Cth)
